Terms & Conditions
Additions to Terms and Conditions due to Covid-19.
Valid from 4th July 2020 until further notice.
1. Pupil and instructor should wear a form of face covering for the duration of the driving lesson.
A face mask may be available from your instructor which may be charged for. Please note the lesson cannot proceed without this.
2. Pupil’s parents, guardians or friends etc. will not be able to sit in on the lessons or test.
3. Pupil and instructor must before each lesson declare if they have any symptoms of Covid-19
Such as consistent cough, high temperature, loss of taste or smell.
4. Pupil and instructor must before each lesson declare if they have been in touch with someone who has been tested positive with Covid-19 or someone with Covid-19 symptoms in the last 7 days.
5. By taking a driving lesson, both the Instructor & pupil agree to their contact details being provided to Government track and trace bodies if so required.
6. Pupil and instructor must before each lesson declare if they have to self-isolate in due to Governments track and trace.
7. Hands must be washed according to current Government guidelines before each lesson and be sanitised before entering the vehicle. Hand sanitiser will be provided by the instructor if pupil has none available.
8. Any bags/ coats etc. must be stored in the boot of the vehicle, (The instructor will open and close the boot). There will be no access to the rear passenger area of the vehicle.
9. The instructor will disinfect all high touch points outside and inside of the vehicle between each lesson.
10. No Visual aids or training resources will be shared between instructor and pupil. Pupil must bring with them pen and paper if they wish to write any reflective notes on lesson progress or update their progress card.
11. In the event of the pupil having or showing symptoms of Covid-19 either before during or after the lesson there will be no further lessons booked for that pupil for 14 days or until the pupil can prove that they have had a test and it is negative.
12. In the event of the pupil testing positive for Covid-19 there will be no further lessons booked for that pupil for a minimum of 14 days and until they have no symptoms.
13. In the event of the pupil having to self- isolate in line with the governments track and trace no further lessons will be booked for that pupil for a minimum of 14 days and they show no symptoms.
14. In the event of your instructor having or showing symptoms of Covid-19 there will be no further lessons booked until they have had a test and it is negative.
15. In the event of your instructor testing positive for Covid-19 there will be no further lessons booked for a minimum of 14 days and until they have no symptoms
16. In the event of the instructor having to self- isolate in line with the governments track and trace no further lessons will be booked for a minimum of 14 days and they show no symptoms.
17. The 48hr cancellation policy is still in place as per previous terms and conditions except for cancellations due to any of the above reasons.
18. In the event of your driving instructor having to cancel appointments because of self-isolating due to Covid-19 reasons, the driving instructor/school will not be liable for any financial losses or otherwise caused by the cancellation.
General Terms and Conditions
1. Our instructors are all local self-employed individuals they are each responsible for money paid and booking dates and times.
2. Pupils that appear to be under the influence of either alcohol, drugs, continues to drive in a dangerous manner, driving in such a way that can cause damage to the tuition vehicle or who are showing in any way violent or abusive behaviour to our Instructors, the general public, DVSA examiners or our Staff will not be taught. If the instructor feels that the situation so warrants, lessons and or test will be terminated immediately and charged for.
3. FIVESTAR Driver Training will make every effort to make available the same instructor and car for your driving lessons & driving test, but cannot be held responsible for situations outside of their control. The school/instructor retains the right to change either if the situation so warrants. Where possible the pupil will be offered a different instructor or car if available. (Also see 24)
4. Mock Tests are available by request, and would require a two hour lesson with your instructor and would need to be booked in advance. (Charges apply)
5. Each pupil will be issued a progress card by their designated instructor on their first lesson. This progress card must be retained by the pupil and produced on each lesson. The progress card also acts as your receipt therefore must be retained for the duration of your lessons with FIVESTAR Driver Training. The progress card contains brief terms and conditions & details of where to find the full terms and conditions i.e. www.fivestardrivertraining.co.uk or www.fivestardrivertraining.com, full acceptance of our full terms and conditions is automatically confirmed after seven day of receipt of progress card or on the second lesson whichever come soonest
6. Lessons booked as an "intensive Course" are usually to be taken between 9am and 5pm Monday to Friday unless special arrangements were made with the instructor at the time of booking. (Price may be higher than published for course lessons during the evening/weekend).
7. Your instructor and or FIVESTAR Driver Training will not sell or rent or provide any of your personally identifiable information to third parties, and will only disclose this information in limited circumstances i.e. on your own personal request or if required to do so by law.
8. It is the pupils responsibility to ensure that the instructor is updated with their current contact telephone number/s and pick up address for their lessons.
9. The instructor will give his/her mobile number to each pupil on the progress card. (Instructors can also be contacted by text). Please be aware that calls may go to answer-phone as instructors are unable to take calls whilst driving/teaching.
10. FIVESTAR Driver Training is contactable by phone on 01708 405353 or 01375 350012 between 9am & 6pm. (Answer phone may be in use occasionally). FIVESTAR Driver Training can also be contacted any time via email : learnwithfivestar@live.co.uk we aim to respond within 48 hours. (Weekends and bank holidays may take extra time)
Payment
11. All block lessons are payable in FULL on or before the first lesson.
12. At least 48 hours’ notice must be given to either cancel or change the date or time of lessons. Any lessons cancelled or changed with less than 48 hours’ notice will still be charged for.
13. All changes to intensive courses once booked must be made at least 14 days prior to start of course failure to do so will result in loss of all fees paid. If enough notice is given (i.e. 14 days) courses can be rescheduled. Test dates may not be able to be changed at short notice. (This would be subject to the DSA & instructors availability)
14. Intensive courses can be booked with a non-refundable deposit of £100.00 plus test fee(s), once this sum has been received theory/practical test dates can be booked. The remainder of the course fee would be due to be paid to the instructor or the school at least 14 days prior to the start of the first lesson/course.
15. All driving courses not paid for in full by the due date will be considered as cancelled by applicant. The deposit/fees paid to that date, will not be refunded.
16. All lesson/course fees can be paid by cash or cheque to either the instructor or the school. Some instructors are able to process debit/credit cards, please check when booking. Payments for block bookings made by bank transfer/card or PayPal must be received at least 48 hours prior to start of lesson. Fees that are to be paid via invoice ideally to be paid before tuition/assessment date, but must be received within 14 days of invoice. Payments made later than 28 days of invoice date will incur a further £20.00 handling fee.
17. Any cheque which is returned by the bank to either the instructor or the school unpaid will incur a £20 administration fee payable in cash.
18. Privacy Policy. - Your instructor and or FIVESTAR Driver Training does not store or currently store any financial details (credit or debit card numbers).
Refunds
19. Lesson & or course fees are non refundable except in exceptional circumstances. Any request for a refund can be dealt with by each individual instructor, and will only be given if there is no other instructor that is able to fulfil the original service as booked. The decision of the instructor/school is final.
20. Lessons once paid for (and or started) are valid for three months. Any extension to this time due to an illness or accident must be agreed by the instructor and noted on the progress card. (Gift Vouchers are valid for 12 months from date of purchase) Only the signed progress card and or original Gift Voucher will be accepted as proof of payment.
Practical Test Dates
21. All practical tests, booked/paid for by candidate or the school are not guaranteed at the end of hours booked. If, in the instructors opinion, the candidate has not reached the standard deemed necessary to pass the practical driving test extra hours may need to be booked and paid for prior to test. (Instructors discretion, also see 24).
22. The instructor/school will never cancel a pupil's practical test. However, if it is considered that the pupil has not reached the required standard and is unwilling or unable to book and pay for further lessons to rectify the problem, the instructor will refuse the use of the tuition vehicle only. This does not prevent the candidate from attending the practical test with an alternative vehicle. (Also see 3 & 24)
23. The instructor always has the right to refuse the use of the school vehicle if he/she feels it is in the interest of public safety.
24. In the event that a pupil has failed a practical test FIVESTAR Driver Training recommends a minimum of 6 hours tuition prior to the next practical test. It is also advised that at least one of these hours should be completed prior to the cancellation date of the practical test. This is to enable the instructor to best advise the pupil on the amount of tuition required prior to the day of the new test. (If this is not adhered to, the tuition vehicle can be withdrawn if in the opinion of the instructor satisfactory progress has not been made).
25. The instructor/school cannot be held responsible for lessons or practical tests cancelled either due to weather conditions or by the DVSA (Driving & Vehicle Standards Agency).
Free Theory Test Training
26. The sample version is available free of charge to anyone through our web-site. Once lessons have been booked and are being taken with one of our driving instructors the full version can be provided free of charge. Theory test date must be added to system when booked and your instructor notified when you pass so we can remove you from system. Pupils not having lessons with FIVESTAR or one of our associated schools will not be given full access. Our theory test training material is provided by theory test pro. All rights are reserved and control remains at all times with them. Pupil will be given free access to the sample version for a minimum of 30 days, after this time if lessons have not been arranged candidates details may be deleted from the system.
27. A FREE Theory training APP is also available via our website and can be downloaded onto a smart phone. FIVESTAR Driver Training share no liability for this download. This app is free to download to anyone pupil or not.
Motoring offences and Liability
28. Clients should be aware that their instructors primary objective is to promote road safety, and in doing so, he/she will have to issue instructions which clients must be prepared to carry out without undue argument.
29. The instructor will make every effort to train you to the highest standard, but can in no way be held liable for any errors or motoring offences the pupil commits whilst driving either accompanied or not accompanied by your instructor either before or after a test pass. The pupil will be responsible for any motoring offences or fines.
30. During an official driving test the pupil is in charge of the vehicle and is liable for any fines or charges levied as a result of any motoring offence committed.
Christmas Offers
31. All lessons booked under our Christmas special offer pricing are valid between 1st November and 31st January & are available to pupils new to Five Star Driver Training only. Lessons taken after 31st January will be charged at our normal rate. (Any lessons booked and paid for in the form of a Gift Voucher will still be valid for 12 months from date of purchase).
College Student Offer 2011/12 (Red & Black postcard) This offer was available in 2011/12 and has now expired.
Complaints
32. All complaints must have been discussed with your instructor prior to contacting the school. If your instructor is unable to settle the matter with you, you may then either call the school direct on 01708 405353 or put your complaint in writing and email to learnwithfivestar@live.co.uk all unsettled complaints must be received by the school within 25 days of the incident.
